EVERGREEN COMMUNITY ASSOCIATION
SUMMARY OF SOLAR INSTALLATION APPLICATION PROCEDURES
The following summarizes the procedure required for you to apply for and obtain approval to install a solar energy system on the roof above your residence.
1. Although Evergreen is a planned development community where each owner owns their separate Lot and the residence on their Lot, the CC&Rs specify that the roofs are part of the Association Maintenance Area.
2. The Association is responsible for the management, operation, maintenance and repair of the roofs as part of its Association Maintenance Area responsibility. As a result, prior to installing a solar energy system on a residence, each owner must obtain Architectural Review Committee (“ARC”) approval.
3. Each solar energy system application will be reviewed by the ARC in accordance with the Evergreen Solar Energy System Application And Installation Policy. All applications for installation of a solar energy system shall comply in all respects with the Evergreen CC&Rs, and Civil Code Sections 714 and 714.1, where applicable.
4. Your solar energy system application must contain, at a minimum, the following: a) Plans detailing the location on the roof and dimensions of the system to be installed, along with detailed specifications for the installation of the solar energy system. b) The system equipment manufacturer and/or model number, as applicable. c) The name and contractor’s license number of the contractor(s) performing the installation work. d) A solar site survey completed by a licensed contractor qualified to install the solar energy system identifying the placement of the solar energy system on the roof to determine the suitability of the area where the equipment is to be installed. e) The application shall clearly show that the installation of your solar energy system is limited to the roof above your residence. FAILURE TO INCLUDE THE ABOVE ITEMS IN YOUR APPLICATION WILL RESULT IN YOUR APPLICATION BEING DEEMED INCOMPLETE AND REJECTED.
5. You can expect to receive a written response to a complete application within 45 days of receiptby the Association. An incomplete application will be denied.
6. You are required to maintain general liability insurance coverage and provide proof of same as a condition of approval.
7. You are required to provide proof that your contractor has general liability and property damage insurance. The Association shall be listed as a Certificate Holder under these insurance policies.
8. Because your solar energy system will be installed on roofs maintained and repaired by the Association as Association Maintenance Area, prior to your being authorized to install your solar energy system, and as a condition of approval to install your solar energy system, you will be required to execute a covenant and license agreement in the form attached to the Evergreen Solar Energy System Application And Installation Policy.
a. The Covenant will contain your maintenance, repair, or replacement responsibility where your solar panels and equipment are placed.
b. The Covenant will contain your obligation to indemnify or reimburse the Association or its members for loss or damage caused by the installation, maintenance, or use of the solar energy system.
c. The Covenant shall be prepared by Association legal counsel and paid for by you an approximate fee of $750.
d. The Covenant shall be signed and notarized by each person on title to the Lot.
e. The signed and notarized Covenant will be recorded by Association legal counsel prior to you proceeding with the solar energy system installation.
FULL AND COMPLETE COMPLIANCE WITH THE ABOVE PROCEDURES IS REQUIRED IN ORDER TO PROCEED WITH YOUR SOLAR ENERGY SYSTEM INSTALLATION.
